TO CONSIDER AMENDMENTS TO
ARTICLES 12 AND 18 OF THE ZONING ORDINANCE

The LEESBURG TOWN COUNCIL will hold a public hearing on TUESDAY, NOVEMBER 10, 2009, at 7:30 p.m. in the Town Council Chamber, 25 West Market Street, Leesburg, Virginia, to consider Zoning Ordinance Text Amendments to Article 12 Landscaping, Screening, Open Space and Lighting to provide for tree preservation during the development process and Article 18 Definitions to add various definitions related to tree preservation efforts as described below:

Sec. 12.1.1 General: Amending existing language to include purpose and intent of the article
Sec. 12.1.2 General Applicability: Amending existing language to clarify which site plan and subdivision applications are subject to the new language of this article
Sec. 12.2 Administration: Adding language to clarify administrative portions of the article
Sec. 12.2.2 Review Procedures: Amending existing language to include review procedures for tree preservation plans
Sec. 12.2.3 Contents of Landscape Plan: Amending existing language requiring tree canopy credit and percent diversity information to be included on landscape plans
Sec. 12.2.4 Contents of a Tree Preservation Plan: Adding language explaining minimum submission requirements for tree preservation plans
Sec. 12.2.5 Monitoring and Enforcement: Amending existing language to enact civil misdemeanor penalties for violations of this article
Sec. 12.3.1 Twenty Year Tree Canopy Requirements: Amending existing language to establish a cost for a tree with a twenty (20) year canopy area
Sec. 12.3.2 Calculations and Exceptions: Amending existing language to define healthy and structurally sound trees and to define trees eligible to meet the minimum canopy requirements
Sec. 12.3.3 Tree Preservation and Tree Canopy Fund: Adding language establishing a tree canopy fund

Sec. 12.8.5 Modification of Screening and Buffer-Yard Requirements: Amending existing language to clarify modification processes
Sec. 12.8.6 Screening: Amending existing language to add table numbers for ease of use
Sec. 12.9.1 Plant Material Specifications Condition: Amending existing language to clarify plant material specifications and requiring a condition evaluation for existing trees
Sec. 12.9.3 Measurement of Size: Amending existing language to define diameter
Sec. 12.9.5 Planting Procedures: Amending existing language to define planting specifications for trees planted for tree cover credit
Sec. 12.9.6 Tree Selection and Cover Guide: Amending existing language to change square footage of canopy credit regulations for large canopy, medium canopy, large evergreen, small evergreen and understory trees and to modify tree selection lists and provide height and spread figures for each species listed
Sec. 12.9.9 Steep Slopes: Adding new language regarding the planting of trees in areas designated as steep slopes
Article 18 Definitions: Adding definitions related to tree preservation to include; tree canopy, landscape plan, tree preservation plan, dedicated school site, tree management report, healthy and structurally sound conditions (40% rule), nursery tree stock, critical root zone (CRZ), small seed stock, tree canopy fund, diameter breast height (DBH), and tree.

TO CONSIDER AMENDMENTS TO
ARTICLE 8 AND APPENDIX A OF THE
DESIGN AND CONSRUCTION STANDARDS MANUAL

The LEESBURG TOWN COUNCIL will hold a public hearing on TUESDAY, NOVEMBER 10, 2009, at 7:30 p.m. in the Town Council Chambers, 25 West Market Street, Leesburg, Virginia, to consider amendments to the Design and Construction Standards Manual Article 8 Vegetation Preservation & Planting to change the criteria for conservation and landscape plans, and Appendix A Construction Standards to add Tree Preservation and Planting Details, and to establish supporting guide graphics as described below:

1. Amend Sec. 8-310.2.A Conservation and Landscape Plans to decrease the diameter at breast height (dbh) limit of the trees that must be shown on the plan from 18 inches to 6 inches, and to reduce the distance from the edge of the disturbed area from 50 feet to 25 feet where the tree inventory must be taken.

2. Amend Appendix A Construction Standards to establish construction details for Tree Protection Fencing, Root Pruning, Tree Preservation Signage, Tree Preservation Narrative and Tree Planting Detail, and to establish supporting guide graphics for the following:
• Tree Inventory and Condition Analysis Guide
• Critical Root Zones and Driplines of Trees
• Energy Conservation Tree Canopy Credit Guide

NOTICE OF PUBLIC HEARING
TRANSPORTATION ENHANCEMENT
GRANT APPLICATION

The LEESBURG TOWN COUNCIL will hold a public hearing in the Town Council Chamber, 25 West Market Street, Leesburg, Virginia on November 10, 2009 at 7:30pm to consider the application for Transportation Enhancement (SAFETEA-LU) grant funds from the Virginia Department of Transportation to fund the Downtown Streetlights capital project.

The submission of a Transportation Enhancement Grant application must include a public hearing in order to be considered for funding.

TO CONSIDER AMENDING THE TOWN CODE TO
PERMIT ALCOHOL AT DESIGNATED TOWN FACILITIES AND EVENTS (CHAPTER 26 PARKS AND RECREATION)

The LEESBURG TOWN COUNCIL will hold a public hearing on TUESDAY, NOVEMBER 10, 2009, at 7:30 p.m. in the Council Chambers at Town Hall, 25 West Market Street, Leesburg, Virginia, 20176, to consider amending Chapter 26, Parks and Recreations, Article II. Park Rules, Sec. 26-26. Behavior, (a) and (b) of the Leesburg Town Code to permit alcohol at designated Town facilities and events.
